(一)從業(yè)婦女的月生育生活津貼標(biāo)準(zhǔn),為本人生產(chǎn)或者流產(chǎn)當(dāng)月所在用人單位上年度職工月平均工資。從業(yè)婦女生產(chǎn)或者流產(chǎn)時(shí)所在用人單位的上年度職工月平均工資高于本市上年度全市職工月平均工資300%的,按300%計(jì)發(fā);低于本市上年度全市職工月平均工資60%的,按60%計(jì)發(fā);但低于人力資源社會(huì)保障局規(guī)定的生育生活津貼最低標(biāo)準(zhǔn)的,按最低標(biāo)準(zhǔn)計(jì)發(fā)。
(二)從業(yè)婦女生產(chǎn)或者流產(chǎn)時(shí)所在用人單位的上年度職工月平均工資高于本市上年度全市職工月平均工資300%以上的,高出部分由用人單位補(bǔ)差。
